Triply Terms of Service

1. The agreement

These terms are the agreement between you and Triply ("we", "us") covering your use of the Triply mobile app and the services behind it. You accept them when you create an account or sign in. If you do not accept them, do not use the app.

Your privacy is covered separately, by the Privacy Policy, which forms part of this agreement.

You must be at least 18 years old, or have the consent of a parent or guardian, to hold a Triply account.

2. What Triply is — and is not

Triply records vehicle trips and turns them into a logbook you can export. It is a record-keeping tool.

Triply is not tax, accounting or legal advice, and we are not your tax practitioner. Whether a trip is deductible, what a tax authority such as SARS will accept, and whether your logbook is complete and correct for a given tax year remain your responsibility and your accountant's. We do not check your records against any tax rule, and we do not file anything on your behalf.

Distances and routes are calculated from your device's GPS and other sensors. Their accuracy depends on your device, your settings, signal conditions and how the operating system treats the app in the background. Triply does its best; it cannot guarantee that every trip is captured, or captured to any particular accuracy. You are responsible for reviewing your logbook and correcting it.

3. Your account

  • You may sign in with an email address and password, or with a Google account. One person, one account.
  • Keep your sign-in details to yourself. You are responsible for what happens under your account, and you should tell us promptly at support@triply.africa if you think someone else has access to it.
  • Give us an email address you actually control. It is how we reach you about your account, and how you recover it.
  • You can delete your account at any time — in the app under Account → Danger zone → Delete account, or on the web at triply.africa/delete-account. See §11.

4. Free trial and Premium

Triply has a free tier and a paid tier, Premium. A new account starts with a 30-day Premium trial, which begins when the account is created and ends 30 days later whether or not you use the app. It does not renew, it costs nothing, and no payment method is required to start it. When it ends, the account continues on the free tier and your data stays where it is — you keep your logbook, you just lose the Premium features.

The trial is for new customers. We may decline to grant a further trial to an account that appears to be a repeat of one that already had one — for example, an account deleted and immediately recreated.

Which features sit behind Premium is shown in the app and may change; if a feature you are actively paying for is removed, §9 applies.

5. Billing, renewal and cancellation

All Premium payments are handled by Google Play, not by us. When you subscribe, you are buying through your Google account under Google Play's own terms, and Google is the merchant of record. We never see or store your card details.

  • Auto-renewal. A Premium subscription renews automatically at the end of each billing period, at the price shown in Google Play at the time, until you cancel it.
  • Cancelling. You cancel in Google Play, at play.google.com/store/account/subscriptions. The app links you straight there. We cannot cancel a Play subscription on your behalf.
  • What cancelling does. It stops the next renewal. It does not end the period you have already paid for: your Premium access runs to the end of that period, and only then drops to the free tier.
  • If a payment fails. Google may give you a grace period to fix your payment method, during which your Premium access continues. If it is still unresolved after that, the subscription goes on hold and Premium access stops until payment succeeds. Fix it in Google Play.
  • Price changes. Google notifies you of a price change and asks you to accept it before it takes effect. If you do not accept, the subscription does not renew.
Deleting your Triply account does not cancel your Google Play subscription. They are separate things and only Google can stop the billing. Cancel in Play first, then delete your account, or Google will keep charging you for an account that no longer exists.

6. Refunds

Because Google Play takes the payment, refunds are handled under Google Play's refund policy, and a refund request goes to Google. If Google declines and you think the circumstances are genuinely ours — a fault on our side that left you unable to use what you paid for — write to support@triply.africa and we will look at it. Nothing here limits any right you have under the Consumer Protection Act 68 of 2008.

7. Your data and your backups

Your trips, vehicles and settings are yours. We do not sell them, and we do not use them for anything other than running the service for you. The Privacy Policy sets out exactly what is collected and why.

  • On your device. Triply works offline and stores your logbook on your device. That copy is yours to manage; if you uninstall the app or wipe the device without a backup, it is gone.
  • Cloud backup. If you enable it, an encrypted copy of your logbook is stored in our backend under your account. It is a convenience, not a guarantee: keep your own exports. Triply can export your logbook to CSV and PDF at any time, and that export is the copy you should be keeping for tax purposes.
  • Encryption. Where a backup is protected by a password you choose, that password is not stored on our servers and we cannot recover it or the backup without it. Losing it means losing that backup.
  • Your obligations. Only put data into Triply that you are entitled to hold — including, if you are logging trips for other drivers, having a lawful basis to record their movements.

8. Acceptable use

Do not:

  • use Triply to break the law, or to build a record you intend to present dishonestly to a tax authority, an employer or an insurer;
  • attempt to gain access to another user's account or data, or to parts of our systems you have not been given access to;
  • probe, scan, overload or otherwise interfere with the service or the infrastructure it runs on;
  • reverse-engineer, decompile or tamper with the app in order to defeat payment, unlock paid features, or forge an entitlement;
  • resell, sublicense or redistribute the app or its output as your own product.

We may suspend or close an account that is doing any of these. Where it is reasonable to do so, we will tell you first.

9. Availability and changes to the app

We aim to keep Triply working and available, but we do not promise it will be uninterrupted or error-free. Maintenance, outages at our providers, app-store changes and mobile-OS changes all happen, and some of them are outside our control.

We may add, change or remove features. If we remove or materially reduce a feature that is part of Premium while you are paying for it, you may cancel and, where the loss is material and you have paid for a period you can no longer use as sold, ask us about a pro-rata remedy at support@triply.africa.

10. Who owns what

We own the Triply app, its name, its design and the software behind it. You get a personal, non-exclusive, non-transferable licence to use it while this agreement is in force, for your own trip records or those of the business you use it for.

You own the data you put in and the logbooks you export. You give us only the permission we need to run the service for you — storing, processing and transmitting your data to provide the features you have enabled, and nothing beyond that.

11. Ending the agreement

You, at any time: cancel any subscription in Google Play, then delete your account in the app (Account → Danger zone → Delete account) or at triply.africa/delete-account. Deleting removes your sign-in, your cloud backup and its settings, and your subscription record. Deleting from inside the app also erases that account's trips, vehicles and linked Bluetooth devices from the device you delete it on. App settings that belong to the phone rather than to the account — your theme, notification choices and tracking preferences — stay behind; clear the app's storage in your device settings to remove those too. It cannot be undone — export your logbook first.

We keep one record that a deletion happened: the date, where it was requested from, and a one-way hash of your email address, never the address itself. It exists so we can answer a later billing question and so the free trial cannot be reset indefinitely. It cannot be used to contact you. This is set out in the Privacy Policy.

Us: we may suspend or close an account for a serious or repeated breach of §8, or if we are required to by law. If we discontinue Triply altogether, we will give reasonable notice and a window to export your data.

Sections 10, 12, 13 and 14 survive the end of this agreement.

12. Disclaimers

Triply is provided "as is" and "as available". To the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. In particular we do not warrant that trip capture will be complete or accurate, that the app will run uninterrupted on every device or Android version, or that a cloud backup will always be available or recoverable.

Nothing in this section excludes anything that cannot lawfully be excluded — including your rights under the Consumer Protection Act 68 of 2008, and liability for death, personal injury, fraud or gross negligence.

13. Limitation of liability

To the fullest extent the law allows, and subject to §12, we are not liable for indirect or consequential loss, for lost profits or business, for tax penalties, disallowed deductions or assessments arising from your records, or for loss of data where you had the means to export or back it up and did not.

Where we are liable, our total liability for all claims in any 12-month period is limited to the greater of the amount you paid us for Triply in that period, or ZAR 500.

These limits do not apply to anything that cannot lawfully be limited under South African law.

14. Governing law and contact

This agreement is governed by the law of the Republic of South Africa, and the South African courts have jurisdiction. If part of it is found unenforceable, the rest continues to apply.

15. Changes to these terms

We may update these terms. The current version is always at triply.africa/terms, which is the link the app points at. If a change materially affects your rights or what you pay, we will tell you in the app or by email before it takes effect. Continuing to use Triply after that is acceptance of the updated terms.
